In light of the foregoing, the Court ORDERS that Defendants David C. Alford and Arcelia Loves motion to dismiss (Dkt. 11) is GRANTED; Judge Ronald B. Kings motion to dismiss (Dkt. 43) is GRANTED; Sheppards motion for summary judgment (Dkt. 10) is DENIED; and Defendants Alford and Defendant Loves motion for sanctions (Dkt. 12) is DENIED. ORDER ADOPTING REPORT AND RECOMMENDATIONS for 29 Report and Recommendations. Because Sheppard both failed to effectively serve any of the Defendants at the time he filed his motions for default judgment, and because all of the Defendants have now made an appearance in the case, the Court finds that entry of default judgment is unwarranted here.
