The Extra Payment provisions of the parties' 2009 and 2011 contracts unambiguously allows Paramount to add fees to the "account balance" for many events beyond collected delinquent payments and scheduled payments received late, including unpaid EFT drafts, unpaid credit card debits, etc.The contracts require Paramount to collect to be entitled to the 9.5% fee on certain delinquent payments and for the "scheduled payments received" after date due.The contracts do not require Paramount to collect funds but only accrual of the event for Paramount to be entitled to a fee for unpaid EFT draft, unpaid credit card debit, unpaid credit card charge back or unpaid customer check. Paramount is entitled to fees for automatic re-clear of NSF check if the NSF check occurred and re-cleared before the end of the 45-day termination period, but not if the NSF check occurred before the end of the 45-day termination period and re-cleared after the end of the 45-day termination period.
