Filing 127 OPINION & ORDER entered and filed 2/15/17: This matter is before the Court following a bench trial held January 11, 2017 through January 13, 2017 between Plaintiffs JTH Tax, Inc. d/b/a Liberty Tax Service and SiempreTax+, LLC ("Plaintiff& #039;") and Defendants Gregory Aime, Wolf Ventures, Inc. d/b/a Wolf Enterprises, Aime Consulting, LLC and Aime Consulting, Inc. ("Defendants"). After the trial, the Court SET ASIDE the Temporary Restraining Order, DENIED Plaintiff& #039;s Claims, and GRANTED IN PART Defendants' Counterclaims. The Court entered Judgment in favor of Defendants and against Plaintiffs JTH Tax, Inc. d/b/a Liberty Tax Service and SiempreTax+, LLC, jointly and severally, in the amount of $2 ,736,896.17 on January 13, 2017. The Court ORDERS that interest shall accrue at the judgment rate from that date of the Judgment of January 13, 2017. Filing 24 OPINION AND ORDER entered 7/29/16 and filed 8/3/16: This matter is before the Court on Plaintiff JTH Tax, Inc. d/b/a Liberty Tax Service andSiempreTax LLC's ("Plaintiff") Motion for a Temporary Restraining Order and a Preliminary Injunction Should Not Issue ("the Motion") Doc. 7 . JTH Tax. Inc. d/b/a Liberty Tax Service and SiempreTax LLC are both Plaintiffs, but for clarity only, the Court refers to them collectively as "Plaintiff." "Should N ot Issue" is an error; Plaintiff does request a preliminary injunction. Doc. 7 at 2. Plaintiff's accompanying brief is entitled "Memorandum of Law in Support of Plaintiff's Motion for a Temporary Restraining Order and Order to Show Cause Why a Preliminary Injunction Should Not Issue." Doc. 8. In a Report and Recommendation ("R&R"), the Magistrate Judge RECOMMENDED that the Motion be GRANTED IN PART. Doc. 16 , as outlined. Defenda nts Gregory Aime, Aime Consulting, LLC, Wolf Ventures, Inc., and Aime Consulting, Inc. ("Defendants") object to the R&R. Doc. 18 . For the reasons outlined in this Opinion and Order, the Court OVERRULES Defendants' obje ctions and ADOPTS, in its entirety, the Magistrate Judge's R&R. Doc. 16. The Court GRANTS IN PART Plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction Should Not Issue. Doc. 7. The facts and history set fort h herein are derived from evidence tendered in the TRO hearing as well as pleadings and motions filed with this Court. These are preliminary factual findings based on the existing record which shall be used for the limited purpose of ruling on the Magistrate Judge's R&R.
