At the hearing Defendant moved, with Plaintiffs consent, for the dismissal of Count Two, which the Court granted. For the reasons set forth in th is Memorandum Order & Opinion, Defendant's 4 Motion to Dismiss Count 1 and III are DENIED. Count II was dismissed for the reasons stated on the record.
