April 28, 2022 Opinion or Order Filing 3 ORDER (Dismissing Case) This matter comes before the Court on its own initiative. In the Court's Order dated April 4, 2022 (ECF No. #2 ), the undersigned advised Plaintiff that failure to file a Ghostwriting Form accompanied by a statement that he has not received assistance in preparing any filing in this case no later than April 25, 2022, would result in dismissal of his case for failure to prosecute pursuant to Federal Rule of Civil Procedure 41 (b). Plaintiff has not filed the required form or attested that he made his filings without assistance. Indeed, Plaintiffs failure to contact the Court indicates to the undersigned that he has abandoned his claim. Accordingly, the Court hereby DISMISSES WITH PREJUDICE Plaintiffs Complaint pursuant to Federal Rule of Civil Procedure 41 (b ). Furthermore, the Court certifies that an appeal in forma pauperis would not be taken in good faith pursuant to 28 U.S.C. l 9 l 5(a)(3). Should Plaintiff wish to appeal this Order, written notice of appeal must be filed with the Clerk within thirty (30) days of the date of entry hereof. Failure to file a notice of appeal within the stated period may result in the loss of the right to appeal. This case is now CLOSED. Signed by District Judge David J. Novak on 4/28/2022.
