FINAL ORDER that the Court GRANTS his amended motion to proceed in forma pauperis and DENIES AS MOOT his initial motion to proceed in forma pauperis. The Court GRANTS Pearson's motion for leave to file a second amended complaint, (ECF No. #7 ), and accepts his second amended complaint as the operative complaint in this matter. The Court DIRECTS the Clerk to docket Pearson's second amended complaint. (ECF No. #7 -1.) The Court, however, DISMISSES Pearson's second amended complaint. the Court DISMISSES Pearson's second amended complaint WITHOUT PREJUDICE and DIRECTS the Clerk to close this case. Furthermore, based on the frivolous nature or Pearson's claims, the Court certifies that an appeal in forma pauperis would not be taken in good faith pursuant to 28 U.S.C. 1915(a)(3). Thus, the Court hereby REVOKES Pearson's in forma pauperis status for the purpose of appeal. Should Pearson wish to appeal this Order, written notice of appeal must be filed with the Clerk of Court within 30 days of the date of entry of this Order. failure to file a notice of appeal within that period may result in the loss of the right to appeal. ORDER that the Court DIRECTS Pearson to file a revised "Application to Proceed in District Court Without Prepaying Fees or Costs" on or before Monday, August 15, 2022. In the revised application, Pearson should clarify his average monthly income in section 1 and his gross monthly pay in section 2. The Court FINDS that the complaint does not plead sufficient facts for the Court to discern whether the complaint states a claim against the defendant. The Court DIRECTS Pearson to file an amended complaint on or before Monday, August 15, 2022. Pearson's amended complaint SHALL comply with the requirements herein. Once filed, the amended complaint will become the operative complaint in this case. Failure to comply strictly with the requirements set forth above will result in dismissal of the case. See Fed. R.
