July 17, 2023 Filing 55 MINUTE ORDER, Motions terminated: #54 MOTION Abuse Of Discretion Review filed by Tiffany Recinos.The following MINUTE ORDER is made by direction of the Court, the Honorable Ricardo S. Martinez, United States District Judge: This case is closed. On June 28, 2023, the Court struck several of Plaintiff's filings and stated it would continue to do so. Dkt. #41. Plaintiff was DIRECTED to "stop filing exhibits, letters, and other similar documents in this closed case." Id. On July 3, 2023, after striking additional filings, the Court warned Plaintiff that if she filed any further documents for an improper purpose or with frivolous legal contentions it may result in monetary sanctions being imposed against her under Federal Rule of Civil Procedure 11. Dkt. #52. Four days later Plaintiff filed a "notice of certiorari" and a "Motion for Abuse of Discretion Review." Dkts. #53 and #54. The notice of certiorari appears to relate to a different case. See Dkt. #53 at 1 ("Tiffany Recinos v. Mike Kreidler, et al."). The Motion is one sentence long and seeks the same relief as Plaintiff's dismissed claims without citing any procedural basis for the Court to do so in this closed case, where the Court lacks subject matter jurisdiction. These filings are frivolous. The Court again warns Plaintiff that if she files any further documents for an improper purpose or with frivolous legal contentions it may result in monetary sanctions being imposed against her under Federal Rule of Civil Procedure 11. Plaintiff cites to no rule or law permitting her to seek default judgment given the Court's lack of subject matter jurisdiction and the procedural history of this case. The Court STRIKES these filings and Motions as procedurally improper and in violation of prior Court Orders. The Court warns Plaintiff that if she files any further documents for an improper purpose or with frivolous legal contentions this may result in monetary sanctions being imposed against her under Federal Rule of Civil Procedure 11.
