Additionally, the defendants counterclaim for declaratory judgment (ECF No. 46 , ECF No. 180 at 25) is GRANTED and the Court DECLARES that Antero owns the rights to the Marcellus depths in the su bject leases, the Ash Lease, the Clark Lease, and the WestLease, free and clear of the rights of first refusal asserted by Bison Resources Corporation because they have been extinguished and are no longer valid.
