DECISION AND ORDER granting 44 Motion for Summary Judgment; granting 48 Motion for Summary Judgment, signed by Chief Judge William C Griesbach on 07/31/2013. Berglunds conduct toward B.B. and M.H. did not violate their constitutional rights. Pla intiffs § 504 claim fails because there is no evidence from which a jury could find that Berglund or Principal Waters intentionally discriminated against Plaintiffs solely on the basis of their disabilities. Thus, the District cannot be liable under a respondeat superior theory. In addition, there is no evidence of discrimination on the part of the District itself.
