DECISION AND ORDER granting in part and denying in part 15 Motion to Dismiss, signed by Chief Judge William C. Griesbach on 12/12/12. Plaintiff's breach of contract claims relating to a breach of the 5/01/2002 Shipbuilding Agreement are dismi ssed. Insofar as plaintiff has alleged breach of contract and breach of warranty claims relating to a subsequent repair agreement, FMG's motion is denied. Plaintiffs have failed to state a negligence claim that entitles them to relief because it is barred by the economic loss doctrine. Accordingly, FMG's motion to dismiss is granted.
