Filing 26 ** TEXT ONLY ORDER ** The COVID-19 pandemic is disrupting everything, including federal civil litigation, and this court is cutting slack as needed. This has resulted in a lot of struck trial dates and a lot of eight- to ten-week extensions. In this case, the parties want a three month bump for all of their deadlines. This doesn't seem entirely necessary on the facts proffered, but the court nonetheless will give the parties most of what they are requesting with the understanding that they are not going to get further extensions without a significantly more persuasive showing that such extensions actually are necessary. Starting at the end, the court is not going to begin a two- to three-week jury trial the week before Thanksgiving. That's not fair to the jurors. The new trial date is November 1, 2021 at 9:00 a.m. This leads to an 11-week extension of the other deadlines: discovery closes August 21, 2020. Experts must be disclosed by plaintiff by September 25, 2020, by defendant by October 30, 2020, rebuttal by November 20, 2020. All dispositive motions and Daubert challenges must be filed by January 29, 2021, with 21/10 response/reply briefing. Settlement letters are due by September 17, 2021. Submissions for the final pretrial conference are due by September 24, 2021, responses by October 8, 2021. The final pretrial conference will be October 19, 2021 at 4:00 p.m. Signed by Magistrate Judge Stephen L. Crocker on 3/23/2020. (voc) |

Filing 7 ** TEXT ONLY ORDER **On September 13, 2019, this court received four Suggestion of Remand and Transfer Orders entered by the District of Arizona in the In Re: Bard IVC Filters Products Liability Litigation, MDL 15-02641. This court cannot accurately discern the status of these cases from the transferring district's docket sheet or zip files. The court would benefit from counsel's input before determining how best to approach these remands. Therefore, not later than September 30, 2019, the parties in each of these cases are to submit a joint status report briefly explaining what already has occurred with these cases in Arizona and what remains to be done in the Western District of Wisconsin. As a heads-up, this court might end up asking the parties to cull from the Arizona docket the documents relevant to each of these four cases for entry into this court's docket, but first we need the status reports. Signed by Magistrate Judge Stephen L. Crocker on 9/16/2019. (arw) |
