Filing 5 ** TEXT ONLY ORDER **Plaintiff Todd Tenneson filed this products-liability suit, contending that the court has jurisdiction under 28 U.S.C. 1332. Dkt. #2 . But for the court to exercise jurisdiction under 1332, the parties must be citizens of different states, and Tenneson has not provided information sufficient to determine the citizenship of defendant Syngenta Crop Protection LLC. Because this defendant is a limited liability company, its citizenship is determined by the citizenship of each of its members. Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). And if any of the members of this defendant are themselves limited liability companies, partnerships, or other similar entities, then the citizenship of those entities must be alleged as well. See Meyerson v. Harrah's E. Chi. Casino, 299 F.3d 616, 617 (7th Cir. 2002) (per curiam). Tenneson may have until April 30, 2021, to file and serve an amended complaint containing good-faith allegations sufficient to establish complete diversity of citizenship. The court will dismiss the complaint for lack of jurisdiction if Tenneson does not file an amended complaint by the deadline. Signed by District Judge James D. Peterson on 4/9/2021. (kwf) |
