May 10, 2024 Opinion or Order Filing 4 ** TEXT ONLY ORDER ** Petitioner Michael Orji seeks a writ of habeas corpus under 28 U.S.C. 2241, stating that he is entitled to sentence credit under the First Step Act that would entitle him to an earlier release date or expedited removal proceedings. Orji already has a 2241 petition pending in the Middle District of Pennsylvania, Case No. 23-cv-1423, concerning the Bureau of Prison's decision to rescind his First Step Act credits. But after filing that petition, Orji was transferred to FCI Oxford, and his second petition contains additional arguments concerning the Immigration Nationality Act. I will direct the clerk of court to serve the petition on respondent at FCI-Oxford, the local United States Attorney, and the United States Attorney General by certified mail, in accordance with Federal Rule of Civil Procedure 4(i). The United States Attorney already responded to Orji's first petition, so I will give respondent a shorter time to answer the petition than this court ordinarily sets in 2241 cases: respondent may have until May 24, 2024, to answer the petition. Petitioner's reply is due May 31, 2024. Signed by District Judge James D. Peterson on 5/10/2024. (voc),(ps)
