Filing 4 ** TEXT ONLY ORDER ** Plaintiff Tyler Frick, who represents himself, alleges that defendant Los Angeles County Sheriff's Department violated his federal statutory and constitutional rights. (Dkt. #1 , at 3.) Because Frick seeks to proceed without prepayment of the entire filing fee, the next step is to screen his complaint and dismiss any portion that is legally frivolous or malicious, fails to state a claim upon which relief may be granted, or asks for money damages from a defendant who by law cannot be sued for money damages. 28 U.S.C. 1915(e)(2)(B). The court accepts Frick's allegations as true and construes them generously, holding his pro se complaint to a less stringent standard than one a lawyer drafts. Arnett v. Webster, 658 F.3d 742, 751 (7th Cir. 2011). Based on the allegations in Frick's complaint, venue is improper in the Western District of Wisconsin. Defendant resides in Los Angeles, California, and the events giving rise to plaintiff's claim occurred there as well. See 28 U.S.C. 1391(b). The court similarly lacks personal jurisdiction over defendant, whose conduct as alleged lacks the necessary "minimum contacts" with Wisconsin. Tamburo v. Dworkin, 601 F.3d 693, 700-01 (7th Cir. 2010) (quoting Int'l Shoe Co. v. Washington, 326 U.S. 310, 316 (1945)). The court will DISMISS the complaint for improper venue and DENY plaintiff leave to replead this case in this district. 28 U.S.C. 1406(a).
