March 8, 2018 Opinion or Order Filing 62 MEMORANDUM OPINION AND ORDER - For the reasons stated above, the Court grants Courtyards motion for summary judgment with respect to Mr. Espeys negligent hiring, training, and supervision claim. The Court dismisses that claim with prejudice. The Cour t denies Courtyards motion for summary judgment with respect to Mr. Martinezs premises liability claim. The Court SETS Mr. Martinezs assault and battery claims against Mr. Espey and Mr. Martinezs premises liability claim against Courtyard for a jury trial at 9:00 a.m. on July 30, 2018. February 24, 2016 Opinion or Order Filing 23 MEMORANDUM OPINION AND ORDER - For the reasons explained above, the Court GRANTS Courtyards motion to dismiss in part. The Court DISMISSES WITH PREJUDICE Mr. Martnezs claims against Courtyard for assault and battery, equal protection, selective enfor cement, and failure to obtain liability insurance (Counts I, II, III, IV, and V). Mr. Martnezs claims against Courtyard for negligent/reckless training and supervision (Count VI) and premises liability (Count VII) will go forward. Courtyards motion to strike is MOOT. (Doc. 18).
