Plaintiff has filed an Amended Complaint as a matter of course under Rule 15(a)(1)(B) of the Federal Rules of Civil Procedure. Accordingly, Plaintiff's Motion for Leave to File Amended Complaint #8 is MOOT. Furthermore, with the Amended Complaint filed, Defendant Alexander's Motion to Dismiss #5 is MOOT. In briefing the Motion to Amend, Plaintiff argues that this case is subject to remand. #10 .
