MEMORANDUM OPINION - For the reasons discussed above, the Court GRANTS IN PART and DENIES IN PART the defendants motion for summary judgment. (Doc. 61). The defendants are entitled to summary judgment on Mr. Moores § 1981 discrimination claims. The defendants motion is DENIED with respect to Mr. Moores § 1981 racial harassment and retaliation claims. By separate order, the Court will set those claims for trial. Additionally, the Court DENIES Mr. Moores motion for leave to file a sur-reply brief and to amend his amended complaint (doc. 73).
