ORDER Defendants' motions to dismiss (Docs. 17 , 22 ) are granted. The complaint (Doc. 1) is dismissed without prejudice. Consistent with the Court's discussion with the parties at the recent Rule 16 conference, Plaintiff is granted lea ve to file an amended complaint on or before March 15, 2013, following which the parties shall have 30 days to attempt to resolve this case. A further scheduling conference will be held on April 17, 2013, at 4:00 p.m. If the case has not been resolved by that date, the Court will set a litigation schedule for completion of the case.
