Filing 12 ORDER: On review, the parties' stipulation for entry of a protective order (Doc. #11 ) is DENIED without prejudice because paragraph 8 of the proposed protective order appears to pre-authorize the filing of confidential-designated material under seal, subject only to compliance with the Court's e-filing protocols. The Court will not approve a protective order that pre-authorizes the filing of documents under seal. Before filing anything under seal, the party asserting confidentiality must file a motion to seal and make the requisite showing of compelling reasons or good cause, depending on the nature of the filing. To that end, LRCiv 5.6(d) explains the default procedure to be followed when a party seeks to file with the Court material designated as confidential by another party. The parties' stipulation therefore is denied without prejudice to them submitting a new protective order that comports with LRCiv 5.6(d) or provides for a comparable procedure. Ordered by Judge Douglas L Rayes on 1/9/2024. This is a TEXT ENTRY ONLY. There is no PDF document associated with this entry. (MMO) |
