MEMORANDUM OPINION AND ORDER AFFIRMING THE JUDGMENT OF THE BANKRUPTCY COURT by Judge Virginia A. Phillips: (see document image for further details). The bankruptcy court did not err in determining that issue preclusion was available under the arbitra tion award Chic and the Forouzeshes secured against Fiene, nordid it abuse its discretion by then giving the award precisely that preclusive effect in these proceedings. Having done so, the bankruptcy court then granted Chic and the Forouzeshes summary judgment properly. The Court therefore AFFIRMS the judgment of the bankruptcy court. (Made JS-6. Case Terminated.)
