MINUTES OF Motion Hearing held before Judge Christina A. Snyder: Defendants' motion for judgment on the pleadings 36 and motion to vacate Magistrate Walsh's 11/8/2011 order 37 are GRANTED. Plaintiff's motion for summary judgment [3 8] is GRANTED insofar as paragraphs 1(a)(e) and 3(b) of her employment agreement are unenforceable. It is DENIED as to the remainder of the employment agreement, as to defendants' 180-day commission policy, and as to defendants' vacation po licy. Defendants' motion for summary judgment 34 is GRANTED as to plaintiff's claim for unpaid overtime pursuant to Cal. Lab. Code Section 510, 1194, and as to the breach of contract and breach of implied covenant of good faith and fair d ealing counterclaim. It is DENIED as to all remaining counterclaims. The Scheduling Conference is continued to 10/1/2012 11:00 AM before Judge Christina A. Snyder. An Updated Joint Report shall be filed on or before 9/24/2012, if necessary.
