Filing 6 ORDER by Chief Judge George H. King summarily remanding improperly removed action to Superior Court of California, Los Angeles County, Bellflower Courthouse, 10025 East Flower Street, Bellflower, CA 90706; Case number 12C02756. (SEE ATTACHED ORDER) Case Terminated. Made JS-6 (Attachments: # 1 returned lodged Notice of Removal) (esa) |
Filing 2 by Magistrate Judge Alicia G. Rosenberg. On December 3, 2012, Defendant Flores (Defendant or Flores), appearing pro se,lodged a Notice Of Removal of this case to this court (Notice).1 Defendant also filed a Request to Proceed In Forma Pauperis. Furt her, should the court lack jurisdiction over this matter, it would be inappropriate to grant in forma pauperis status at this time. In a case removed from state court, a district court must remand the case to state court if it appears at any time be fore final judgment that the district court lacks subject matter jurisdiction. Defendant is therefore ORDERED TO SHOW CAUSE on or before December 21,2012, why her Request to Proceed In Forma Pauperis should not be denied and why this action should no t be remanded to state court based upon a lack of subject matter jurisdiction. Failure to timely file a response and declaration will result in denial of Defendant's in forma pauper is application and an order remanding the action to state court. (See Order for details.) (mp) |
