Filing 24 ORDER LIFTING STAY AND DISMISSING ACTION PURSUANT TO FEDERAL RULE OF CIVIL PROCEDURE 41(a) #23 by Judge George H. Wu. The parties to the above-captioned action, by and through counsel, hereby stipulate and agree as follows: 1. On December 10, 2014, at the request of the parties, this Court entered an order staying this matter pending the outcome of the Prime Healthcare Cases, Los Angeles County Superior Court, Case No. JCCP 4580. 2. The parties agreed to refer claims in the Prime Healthcare Cases, Los Angeles County Superior Court, Case No. JCCP 4580, to binding arbitration administered by JAMS, and the parties further agreed to refer all claims in the above-captioned action to the same binding arbitration. This agreement was entered as a settlement in open court in the Los Angeles Superior Court on February 8, 2015, in accordance with California Code of Civil Procedure section 664.6 in Prime Healthcare Cases, Los Angeles County Superior Court, Case No. JCCP 4580. 3. Plaintiffs now wish to voluntarily dismiss this matter without prejudice so that all issues can be finally determined in the JAMS binding arbitration. Defendant does not oppose the dismissal. 4. The parties therefore stipulate to this Court lifting the stay entered on December 10, 2014, so that this action may be dismissed, and further stipulate to dismissing this action without prejudice (since the issues in this Action will be determined in the JAMS arbitration). 5.
