November 5, 2015 Opinion or Order Filing 125 MINUTE ORDER (In Chambers) - ORDER STAYING Case Pending Ninth Circuit Ruling on Order Denying Plaintiffs' Motion for Preliminary Injunction by Judge Andre Birotte Jr. For the foregoing reasons, it is hereby ORDERED that this action is STAYED pending the Ninth Circuit's ruling on the Court's Order Denying Plaintiffs' Motion for Preliminary Injunction. To permit the Court to monitor this action, the Court ORDERS the parties to file periodic joint status reports on the status of the appeal. The first such report is to be filed on February 1, 2016, unless the stay is lifted sooner. The parties shall file successive joint reports every 30 days thereafter. Each report must indicate on the face page the date on which the next report is due. May 13, 2015 Opinion or Order Filing 87 ORDER DENYING PLAINTIFFS' MOTION FOR A PRELIMINARY INJUNCTION; AND ORDER DENYING DEFENDANT'S MOTION TO STRIKE by Judge Andre Birotte Jr.: Plaintiffs seek a preliminary injunction staying the effective date and enjoining enforcement of the City's Wage Ordinance, mandating a $15.37 per hour minimum wage for Hotel Workers at large Hotels in Los Angeles, which is scheduled to go into effect on July 1, 2015. Plaintiffs argue that the Wage Ordinance is preempted under the NLRA. A review of Plaintiffs' arguments and evidence, however, make clear that Plaintiffs' biggest concern with the Wage Ordinance is that it is bad economic policy. However, it is not the role of the Court to interject into matters of legislative economic policy under the guise of NLRA preemption. When Plaintiffs' arguments and evidence are considered against the backdrop of the NLRA preemption legal standard, Plaintiffs have not satisfied their high burden for the extraordinary and drastic remedy of preliminary injunctive relief. Accordingly, because the Plaintiffs have failed to show any likelihood of success on the merits of their NLRA preemption claim, their motion for a preliminary injunction staying the effective date and enjoining enforcement of the Wage Ordinance is DENIED #23 . The City's motion to strike #62 is DENIED as moot, as it is duplicative in substance to the City's separately filed objections. (cb)
