Filing 14 STIPULATION AND ORDER signed by Chief Judge Morrison C. England, Jr. on 3/13/2015 ORDERING 13 no later than 6/30/2016 the Service shall submit to the Federal Register for publication a 12-month finding as to whether the listing of the Eagle Lake ra inbow trout as a threatened or endangered species is warranted; Defendants agree to pay Plaintiff $10,850.00 in settlement of the attorneys' fees and costs in this matter; the terms of this Agreement shall become effective upon entry of an order by the Court adopting the Agreement; upon adoption of this Agreement by the Court, all counts of Plaintiff's complaint shall be dismissed with prejudice; Notwithstanding the dismissal of this action, however, the parties hereby stipulate a nd respectfully request that the Court retain jurisdiction to oversee compliance with the terms of this Agreement and to resolve any motions to modify such terms; the terms and conditions of the parties' Stipulated Settlement Agreement are hereby ADOPTED as a enforceable ORDER of this Court.
