OPINION and JUDGMENT filed: The district court's dismissal of the Miks' complaint with respect to their claim for wrongful eviction is REVERSED. The district court's dismissal of the Miks' claim for denial of due process and outrageous infliction of emotional distress is AFFIRMED. Decision for publication.
