We REVERSE the district court's grant of summary judgment to Local 881 on Count 1 of Rupcich's Amended Complaint (Breach of Local 881's Duty of Fair Representation) and to Jewel on Count 2 (Breach of Contract and Wrongful Termination). We AFFIRM the district court's denial of Rupcich's motions for summary judgment; and, REMAND this case for further proceedings. Michael S.
