Drendolyn Sims v. Mike Stanton Featured Case

Before the court is the question whether a police officer's pursuit of a person suspected of a jailable misdemeanor onto another person's private property is clearly established as a constitutional violation, in which case the officer is not entitled to qualified immunity. The Ninth Circuit panel held that the officer in this case is not entitled to qualified immunity because warrantless entry into private property in pursuit of a person suspected of only a misdemeanor violates clearly established constitutional law.
