December 21, 2009	Filing 15 ORDER Directing Entry of Final Judgment and Order of Dismissal with Prejudice re: 95 Order Preliminarily Approving Settlement (filed in 05-cv-01265). Court retains continuing jurisdiction over settlement as set forth in the order. In the event th at the settlement does not become effective in accordance with the terms of the Stipulation, or the Effective Date does not occur, or in the event that the Settlement Fund, or any portion thereof, is returned to the Defendants or their insurers, then this Judgment shall be rendered null and void and shall be vacated and, in such event, all orders entered and releases delivered in connection herewith shall be null and void to the extent provided by and in accordance with the Stipulation. The Lit igation and all claims contained therein, as well as all of the Released Claims, are dismissed with prejudice as to the Lead Plaintiff and the other Members of the Class, as against each and all of the Released Persons. The Settling Parties are to bear their own costs, except as otherwise provided in the Stipulation. Judgment shall be entered dismissing the Litigation with prejudice and on the merits, by Judge Walker D. Miller on 12/21/09. (gms, )
