The Court finds, based on the record before it, that all of the requirements of Rules 23(a) and 23(b)(3) of the Federal Rules of Civil Procedure have been satisfied for purposes of certifying a settlement class. Court reserves jurisdiction over this matter, the Parties, and all counsel herein, without affecting the finality of this Final Judgment. The Settlement and this Final Judgment shall have no res judicata, collateral estoppel, or other preclusive effect as to any claims other than the Settled Claims by Judge John L. Kane on 04/07/09.
