Filing 18 RULING (see attached) granting in part 7 Defendants' Motion to Dismiss. The following counts in Plaintiff's 1 Complaint are DISMISSED: Count One, for violation of Title III of the ADA, 42 U.S.C. § 12189, against all Defen dants; Counts Two and Three, for violation of Title II of the ADA, 42 U.S.C. §12132, and of § 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794, against the individual defendants in their individual or personal capacities; Count Four, arising under 42 U.S.C. § 1983 for alleged violation of the Equal Protection Clause, against all Defendants; and Count Five, for "arbitrary and capricious" behavior under Connecticut state law. The remaining claims in this acti on are: Counts Two and Three, violation of Title II of the ADA, 42 U.S.C. § 12132, and of § 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794, against NCC and the individual defendants in their official capacities. The Court holds in reserve its decision with respect to the issue of sufficiency of service and directs the parties to file and serve briefs in compliance with this Ruling. Signed by Judge Charles S.
