ORDER granting 24 Motion for Summary Judgment. For the reasons contained in the attached ruling, defendants' motion for summary judgment (Doc. #24) is granted with respect to plaintiff's constitutional claim of excessive force on the gro und that defendants have qualified immunity. Plaintiff's remaining state law claims for wrongful death are otherwise dismissed without prejudice.The Clerk is directed to close this case. It is so ordered. Signed by Judge Jeffrey A.
