Filing 27 ORDER granting 26 Motion to Remand to State Court and amending the 25 Summary Judgment Ruling accordingly, as reflected in the attached Amended Summary Judgment Ruling. The Court files this Amended Summary Judgment Ruling to clarify one point. In its initial ruling filed on August 15, 2016, the Court dismissed the sole remaining state law claim in this case, because it had dismissed all of the federal claims in the case and declined to exercise supplemental jurisdiction over the only stat e law claim under 28 U.S.C. § 1367(c)(3). However, as explained in the attached ruling, because this case was initiated in Connecticut Superior Court and removed to this Court, the proper course of action was to remand that state law claim to t he Connecticut Superior Court. Accordingly, this Amended Ruling is identical to the August 15, 2016 ruling except that the Court does not dismiss but rather remands the defamation claim to Connecticut Superior Court. The Clerk is directed to enter judgment for the Defendants on the malicious prosecution claims, to remand the remaining defamation claim to the Connecticut Superior Court, and to close this file.. Signed by Judge Victor A. Bolden on 8/18/2016. (Dearing, S.) |
