Filing 71 ORDER GRANTING MOTIONS TO DISMISS AND FOR SUMMARY JUDGMENT. For the reasons stated in the attached ruling, the Court GRANTS defendant Lloyd Fenstermaker's motions to dismiss (Docs. # 27 , 28 ) and motion for summary judgment (Doc. # 29 ). The C ourt also GRANTS defendant Martha Czymmek's motion to dismiss (Doc. # 41 ). Because there is no basis for a claim against these defendants, there is also no basis for plaintiff's claim against defendant PNC Bank, who shall also be dismissed as a defendant. Plaintiff's motion for costs and fees (Doc. # 50 ) is DENIED. The Clerk of Court shall close this case. It is so ordered. Signed by Judge Jeffrey A. Meyer on 3/26/2018. (Zuckier, C.) |
