Filing 222 MEMORANDUM OF DECISION AND ORDER: For the reasons discussed in the attached Memorandum of Decision and Order, the Court finds that PMC directly infringed the 629 Patent, and that Plaintiffs are entitled to a permanent injunction. Accordingly, the Cou rt ORDERS that PMC be permanently enjoined from making, using, offering for sale, or selling in the United States the ColorSnap system, replacement parts to repair previously sold ColorSnap systems, or any colorable imitations thereof, until May 17, 2019--the date on which the 629 Patent will expire. The Court does not, however, find this case exceptional and does not award Plaintiffs attorneys fees and costs. The Clerk of the Court is directed to enter judgment for Plaintiffs and close this case. The Court shall retain jurisdiction of this case for the purpose of enforcing the terms of the permanent injunction. Signed by Judge Victor A. Bolden on 12/18/2018.(Baran, Hugh) |
