February 23, 2023 Opinion or Order Filing 11 ORDER granting #10 Defendants' Motion for Extension of Time until March 23, 2023, to respond to the complaint. The Court notes that, although the motion represents that Defendants have been served with the complaint, Plaintiff has not filed proof of service as required by Federal Rule of Civil Procedure 4(l). Accordingly, Plaintiff must file proof of service by March 2, 2023. In addition, counsel are reminded that pursuant to Local Rule 7(b)(3): "All motions for extension of time shall be filed at least three (3) business days before the deadline sought to be extended, except in cases in which compelling circumstances warranting an extension arise during the three days before the deadline. Future failures to comply with Local Rule 7(b)(3) may result in the denial of non-compliant motions for extension of time without prejudice to refiling of a compliant motion.
