"It is well-settled that a district court has discretion to halt discovery pending its decision on" a preliminary dispositive motion. See Gandler v. Nazarov, No. 94 Civ. 2272 (CSH), 1994 WL 702004, at *4 (S.D.N.Y. Dec. 14, 1994). A district court's authority to stay discovery derives from Fed. R. Civ. P. 26(c), which permits the court to issue protective orders pertaining to discovery for good cause. See Dome Tech., LLC v. Golden Sands Gen. Contractors, Inc., No. 3:16-cv-1607-VAB, 2017 WL 11577923, at *1 (D. Conn. July 24, 2017). In light of the possible transfer of this case to the MDL, or the possible remand of this case back to Connecticut Superior Court, the Court finds good cause to stay discovery and the requirements of Rule 26(f) until either this Court's resolution of Plaintiffs' motion to remand, ECF No. #17 , or the Judicial Panel on Multidistrict Litigation's resolution of Plaintiffs' objection to its conditional transfer order. The Court will consider Defendants' motion to stay proceedings, ECF No. #26 , after receiving Plaintiffs' response and before the oral argument on Plaintiffs' motion to remand, scheduled for May 17, 2023. Objections to the conditional transfer order must be filed with the Clerk of the Judicial Panel on Multidistrict Litigation by March 22, 2023, which will continue the present stay of the transfer until the Judicial Panel on Multidistrict Litigation considers the objections. By March 29, 2023, if the stay of the transfer has not yet been lifted, the parties shall file a joint status report informing the Court (1) whether Plaintiffs objected to the transfer and, if so, (2) whether the Panel has set a schedule for the briefing and consideration of Plaintiffs' objection. In the event that Plaintiffs object to the transfer in light of their pending motion to remand this case back to Connecticut Superior Court, the Court grants Defendants' motion for reconsideration, vacates the briefing schedule set at ECF No. 18, and sets a new briefing schedule pursuant to Local Rule 7.
