The Clerk of the Court is DIRECTED to enter judgment in favor o f Plaintiff and against Defendant Cold Ground Transport, LLC as to Count I only for the actual loss amount. Counts II and III of the Complaint are dismissed. The Clerk of the Court is further DIRECTED to terminate all pending deadlines, issue the attached Bill of Costs, and close the file.
