Filing 26 ORDER: Defendant's Motion to Dismiss Plaintiff's Complaint with Prejudice (Doc. 21) is GRANTED in part. Plaintiff's claims for violations of the minimum-wage requirements under the FLSA and the FMWA (Counts I and II) are DISMISSE D with prejudice for failure to state a claim. Plaintiff's claim for unpaid overtime wages under the FLSA (Count III) is DISMISSED without prejudice. Within fourteen (14) days of the date of this Order, Plaintiff may file an amended complaint correcting the deficiencies noted above as to his claim for unpaid overtime compensation under the FLSA (Count III).
