This motion seeks discovery or production of documents. This is not how discovery is undertaken in the Middle District of Florida. Plaintiff must read the local rules (on the web site) and the Federal Rules of Civil Procedure. One does not move the court to produce records. Once the complaint is served and defendants' answers are on file (meaning any motion to dismiss has been denied by the court), upon completion of a case management conference among the parties then Plaintiff serves requests for discovery upon the parties or subpoenas for discovery if the persons holding the records are not parties to the suit. One does not involve the judge in producing these and the production of records in case discovery is designed to go forward without judicial involvement. Only if the parties impasse or disagree and there is refusal to comply with the properly-served requests to produce does one involve the judge.
