REPORT AND RECOMMENDATION: In light of the foregoing, it is respectfully RECOMMENDED that Defendants' motion to dismiss, doc. 52 , be GRANTED and Plaintiff's amended complaint, doc. 43 , be DISMISSED as to the federal D efendants. It is further RECOMMENDED that the Plaintiff's motion to strike, doc. 56 , is DENIED as the FTEPA survives constitutional scrutiny and the challenge to the Age 60 Rule is moot. Finally, it is recommended that the case be REMANDED to the undersigned for further proceedings as to the claims remaining against United Air Lines.
