ORDER granting in part and denying in part 3 MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM. Count I is DISMISSED with prejudice as to all Defendants except Defendant Powell. Count II remains. Defendants motion to strike allegations of ordinary negligence is DENIED. Defendants motion for more definite statement is GRANTED as to causation.
