August 9, 2016 Opinion or Order Filing 141 ENDORSED ORDER denying Defendant's Motion for Attorney's Fees as Sanction [ECF No. 124] and denying Plaintiff's Motion for Sanctions Pursuant to Federal Rule of Civil Procedure 11 [ECF No. 135-1]. The Court finds that sanctions are not warranted against either Plaintiff or Defendant. While there were flaws in Plaintiff's action, including a lack of subject matter jurisdiction, the Court does not find Plaintiff or his counsel's conduct so unreasonable as to require a penalty. The Court notes that Defendant could have ascertained and/or raised many of the alleged issues early on in the litigation, but instead repeatedly disregarded this Court's orders and the rules of procedure.
