Filing 9 ORDER DISMISSING COMPLAINT AND DENYING IN FORMA PAUPERIS REQUEST. Signed by JUDGE DERRICK K. WATSON on 7/7/2014. (1) The Complaint is DISMISSED for failure to state a claim. (2) Plaintiff may file an amended complaint curing the d eficiencies noted above on or before August 6, 2014. Failure to timely amend the Complaint and cure its pleading deficiencies may result in DISMISSAL of this action for failure to state a claim, and may be counted as a strike pursuant to 28 U.S.C. & #167; 1915(g). (3) Plaintiff's in forma pauperis request is DENIED. Failure to pay the Courts filing fee, or to submit a fully completed in forma pauperis application on or before August 6, 2014, may result in dismissal of this action for fai lure to prosecute or obey a court order, regardless of whether Plaintiff submits an amended complaint. (4) In the alternative, Plaintiff may voluntarily dismiss this action without prejudice on or before August 6, 2014, by submitting a letter to the Clerk of Court to that effect. If Plaintiff voluntarily dismisses this action, he will not be subject to payment of the filing fee or possible accrual of a strike pursuant to 28 U.S.C. § 1915(g). (5) The Clerk of Court is directed to mail P laintiff a form prisoner civil rights complaint and in forma pauperis application so he can comply with the directions in this Order.
