OPINION entered by Judge Michael P. McCuskey on 10/17/13. Plaintiff did not pay the full $350.00 filing fee, as ordered in Opinion 16 , and this court has concluded that dismissal of this case is warranted because Plaintiff intentionally omitte d material information from his list of his prior lawsuits. However, because this court did not warn Plaintiff of the consequences of failing to provide accurate litigation information prior to the filing of his Amended Complaint, this dismissal will be without prejudice, and Plaintiff may proceed with this case if he pays the filing fee in full. Plaintiff is liable for the filing fee and is again WARNED that if he seeks to file any future action in this court that fails to notify the court of his three-strikes status and litigation history, that action shall be subject to immediate dismissal.
