Filing 7 MERIT REVIEW OPINION entered by Judge Sue E. Myerscough on 3/21/2017. Pursuant to its merit review of the Complaint under 28 U.S.C. § 1915A, the Court finds that the Plaintiff states Eighth Amendment claims for excessive force against Defendant Smith, failure to intervene against Defendants Prentice and Bennett, and deliberate indifference to a serious medical need against Nurse Foy. Plaintiff's motion for the Court to try to find pro bono counsel to represent him is denied 4 , with leave to renew after Plaintiff demonstrates that he has made reasonable efforts to find counsel on his own. Plaintiff's motion to attach his grievance to his complaint 6 is granted, to the extent that the grievance has been filed in the docket. This case is now in the process of service. HIPAA Order to enter. (MAS, ilcd) |
