At this time, Plaintiff's cause of action against Defendants Lay and Wessel shall proceed. The final pretrial conference is rescheduled for 10/9/2012 at 1:30 p.m. Defense counsel shall appear in person, while Plaintiff shall appear by video conference. The parties shall agree upon and submit a proposed, final pretrial order at least fourteen days before the Final Pretrial Conference (Final Proposed Pre-Trial Order due by 9/25/2012). By March 30, 2012, the remaining Defendants may file a summary judgment motion on the remaining claims. A final pretrial conference is scheduled for Monday, September 17, 2012, at 2:30 p.m. Defense cou nsel shall appear in person. Plaintiff shall appear by video conference. The parties are directed to submit an agreed, proposed final pretrial order at least fourteen days before the final pretrial conference. A jury trial is scheduled on the Cour t's trailing trial calendar for Tuesday, November 6, 2012 at 9:00 a.m. The final date for jury selection and trial will be determined at the final pretrial conference.
