Filing 178 MEMORANDUM Opinion and Order. This court grants Tellabs "Motion for Judgment on the Pleadings" in full. (Dkt. No. 140). Tellabs counterclaims are not time-barred due to the Illinois savings clause. Tellabs has satisfied the savings clause& #039;s requirement that the Fujitsu Parties' claims arose before Tellabs' counterclaims and third-party claims were time-barred. Tellabs may prosecute its counterclaims against both Fujitsu and FNC, in spite of FNC's third-party statu s in this action, because this case is inherently connected with case no. 09 C 4530 where FNC was a plaintiff. Fujitsu Limiteds answer to Tellabs 039; counterclaim and FNC's third-party answer to Tellabs' joined counterclaim, which is to be treated by Tellabs and FNC as a Rule 14 third-party complaint, are each to be filed on or before 10/22/13. Filing 30 MEMORANDUM Opinion and Order. For the reasons set forth above, Tellabs' "Motion for Reclassification and Use of Documents Produced Under the Protective Order" (09 C 4530, Dkt. No. 1069) is granted and the court holds that the "Con tested Information," as defined by this order, is no longer protected or confidential under the terms of the parties' stipulated amended protective orders or any previous court order in these two related pending cases. Consistent with this holding, Tellabs may disclose the Contested Information to its in-house counsel and senior management in advance of the upcoming April 14, 2013 mediation with Mr. Sternstein.
