MEMORANDUM Opinion and Order:For the reasons previously stated, the 12(c) portion of the Pierce Defendantsmotion to dismiss, R. 84, is denied without prejudice. Because the Court maintains jurisdiction of Counts I, II, X, XI, and XVI of Ultra Greens third party complaint, the 12(b)(1) portion of the Pierce Defendants motion to dismiss, R. 84, is also denied without prejudice. Alternatively, neither party has requested that the Court convert the instant motion to one for summary judgment. If the parties would like the Court to do so in light of the above ruling, then they may so move. This way, both Parties will have notice of the relevant standard of review and have the opportunity to submit additional evidentiary material of their own.
