ORDER ; Defendant's uncontested motion to dismiss the complaint for failure to state a claim [# 12 ] is granted. The complaint is dismissed without prejudice pursuant to Fed. R. Civ. P. 8 and 12(b)(6). Plaintiff is granted until January 3, 20 14 to submit an amended complaint curing pleading deficiencies. The Clerk will provide Plaintiff with an amended civil rights complaint form and instructions along with a copy of this order.
